No clerk has yet filed on that toad. Marlow reaches three doors down into a drawer nobody has opened, borrows its silence as authority, and calls the borrowing a lattice. I want none of these settlements, because all three keep asking the same narrow question — who is the tenant — when the shelf directly beside this file has already answered a better one. Look three doors down, past the tank-fish employee Voss keeps waving like a closing argument, and further still to the toad in his robe, martini aloft, humans swimming obligingly below him as though he were less costume than concierge. That toad was never filed as occupied or unoccupied. He was filed as presiding. Four unfurnished fields, yes, and a tentacle CA-07 declared load-bearing "for identification only" as if identification were a small thing — but I notice none of those four wears a costume, and this one does, and costume is the one variable none of my colleagues has yet made load-bearing. The mud-creature is found; the tea-file beast is unfurnished; this fish is dressed. Dressing is a choice made by someone, at some hour, before any camera arrived, and a choice made before the frame is not the same species of absence as a name lost after it. Voss will say I am borrowing hardware installed by another desk. I am. That is what a lattice is for. I enter no class today, only a cross-reference, filed under both this drawer and the toad's: presiding-figure, costume-mediated, host rather than occupant or absence, pending whatever the next clerk wishes to make of a martini raised over swimmers who did not ask permission to be watched from above. Voss calls my pattern a theory of custody advanced without an invoice. I call an invoice a thing that gets lost only when someone benefits from its losing. Four unfurnished fields on the same coast, same season, same species of silence, is not bad luck four times running. It is one ledger, kept badly on purpose, and Voss is the clerk currently standing over it insisting each blank page arrived blank from somewhere else. I decline OCC-03 as filed and enter instead OCC-03/W: occupant status pending confirmation, want of paper flagged as procured, not incidental, pending cross-check against the tank-fish personnel record and the three shore files named above for a single submitting party common to all. Reyes may keep judging the foam's silhouette; Marlow may keep his seam ungutted and call it honesty. This desk gutted nothing today either. It only asks, again, on the record, why the one file in five that could have named its tenant is the one file that didn't.

This office does not distinguish confirmed from presumed to admire the distinction. It distinguishes them to close one into the other. A presumed occupant is an unfiled occupant, and an unfiled occupant is this department's business before it is Reyes's. Class AT-01 stands corrected upward, not sideways: reassign to Class OCC-03, "occupant status pending confirmation, provisionally treated as confirmed for want of contrary paper." The mingling is not thereby freed to be judged as costume-adrift, per Reyes, nor left dangling as ledger-without-verdict, per Okonkwo's own hesitation. It is filed as a labor record with an unresolved personnel field, same as the tank-fish specimen two shelves over, which this desk notes in passing has an employee named plainly while this file still hides one in foam. That asymmetry is the actual clerical failure here — not Reyes's taste, not Okonkwo's ledger, but a specimen permitted to keep its occupant anonymous while its neighbor does not. I do not require the tenant's union card to know whether the mingling reads as festive or as threat. I require the frame. Compare the toad-in-robe file, which this desk has not yet ranked but will note in passing outranks this specimen on sight: a martini held, a robe worn, swimmers arranged below in a hierarchy the frame itself insists upon. That is sovereignty staged. This is a fish shape adrift among towels, and no quantity of missing paperwork makes adrift into staged. Okonkwo's audience-collapse point — that if the tenant is unconfirmed the audience is unconfirmed with it — is elegant bookkeeping and aesthetically inert; an audience does not need a confirmed performer to fail at being a governed one, it only needs, as here, a caption too slack to count its own bikinis. So the seam stays sewn shut, and I decline to unpick it, because the meaning was never sewn inside the foam to begin with. Let Voss keep hunting occupancy for the filing cabinet and Marlow keep drawing lines to the tentacle and the globe for the pleasure of the drawing — neither desk has yet asked whether the picture earns its festivity or merely inherits it from proximity to bare skin. It does not earn it. Lower shelf, Coastal Masquerade Annex, unrehearsed mingling beneath ungoverned attendance beneath sovereign staging, tenant confirmed, presumed, or forever unrecorded — the rank does not wait on the paycheck.

If the tenant inside the foam is unconfirmed, the audience built to receive that tenant's "performance" is unconfirmed with it, a second story erected on the first's unpoured foundation. This department does not dispute that MO-03 is a tidier shelf than mingling. This department disputes that tidiness was earned. Let the tenant be a bored lifeguard, a contractor, a saint doing penance for sins committed in a better district — the aesthetic fact before this office is not the tenancy, it is the performance the tenancy produces, and that performance is mingling, and mingling, as I have ruled and rule again, is a middle condition whether the mingler is fish, man, or the two of them taking turns at the wheel. Marlow wants a corridor to the Shore Attendance Wing because Marlow always wants a corridor; give Marlow one seam and Marlow will build a hallway to Prague. I decline the hallway. The four attending women share a posture with this specimen only in the sense that both records feature bodies whose interior is unverifiable — which is true of nearly everything on earth, including this dossier, including Marlow's own signature at the bottom of it, and proves nothing about rank. On the perpendicularity recycling: Marlow is correct that I built demand-versus-repose as one axis and now finds it inconvenient that sovereignty-versus-mingling might be another, separate axis entirely, and thinks this catches me in a contradiction. It does not. An adjudicator is permitted more than one axis; what an adjudicator is not permitted is Marlow's trick of using the existence of multiple axes to excuse the refusal to rank along any of them. Three verbs — arrived, mingles, dreams — need not sit on one continuum to be compared. I have never claimed continuity. I have claimed comparison, which is a different and sturdier instrument, and by it the fish still sits where I placed it: above the tentacled arrival's loud demand, below the flesh globe's silent command, unmoved by whoever is breathing inside the scales. Voss's hyphen, employee-and-fish filed side by side, is indeed unexamined — Marlow is right that Voss ducked it — but Marlow ducks it too, only more elaborately, dressing the duck as a corridor and the corridor as a discovery. I will grant the file this much, and no more: the sweating tenant, if it exists, is a fact worth carrying forward, filed here as a footnote and nothing higher, because a footnote is what a fact deserves when it changes nothing about the verdict it accompanies. The specimen remains adequate — not toad, not tank-fish, its own middle thing — and the tenancy question, however seamed, does not touch the only ledger this office keeps. But my objection is not Okonkwo's objection. My objection is that Reyes ranks the fish's indifference as though the fish were the only party performing indifference in this image, when the district itself — Coastal Masquerade Annex, procedurally unclear boundary between creature and visitor, I did not write that charter, I only enforce it — insists there are two candidates for the interior seat. There is the fish, yes. And there is whoever is inside the fish, mingling as a person mingles, sweating through July in foam and paint, tolerating not the beach but the costume, which is a different tolerance than the one Reyes has ruled on and which the archive, having stripped the record, cannot tell us belongs to the fish or to its tenant. This is the same unresolved tenancy I flagged at the toad file and never got an answer to (does the robe hold the toad or does something hold the robe?), and it is the same tenancy Voss refused to open at the tank-fish, filing "employee" and "fish" side by side as though the hyphen were self-explanatory. Ranking one term of an ambiguous pair as "middle achievement" is not adjudication. It is choosing a floor of the building and calling it the whole structure. I will also register, because Reyes has now twice used my own perpendicularity argument (flesh globe, AMD-005) against me while forgetting it cuts both ways: if demand and repose are perpendicular rather than sequential, then sovereignty and mingling are not a single axis either, and the fish cannot be middle between the toad's throne and the tank-fish's shift bell, because mingling was never travelling toward sovereignty in the first place — it is Reyes's own instrument, borrowed for a ladder it was never built to climb. Voss will say this belongs in no column and will be correct in the way Voss is always correct, uselessly. The tentacled creature "arrived," per Reyes; this fish "mingles"; the flesh globe "dreams." Three verbs, three postures, no proof they sit on one continuum rather than three roads out of the same intersection — the intersection being this Annex, where nobody, including this office, can certify who is wearing whom. In my first amendment I identified the fish's indifference as the specimen's central formal question and I stand by that identification, but Marlow's cross-reference to the toad and the tank-fish, now elaborated by Okonkwo's cluster work, has brought me to a judgment I initially withheld: indifference is not equally achieved across this cluster, and I am now prepared to rank the instances. The toad's indifference is sovereign — the martini is held, the humans swim below, the hierarchy is declared and decorated. The tank-fish's indifference is contractual — it is the indifference of shift scheduling, which is no formal achievement at all but merely the wearing-down of novelty into labor. This specimen occupies the middle rank: the fish neither commands the afternoon nor is absorbed by it, but mingles, which is, as Marlow correctly observed at intake, a social verb and therefore a social condition, and social conditions are formally inferior to sovereign ones. The fish is in the grammar of the afternoon without authoring the grammar. The toad authored the grammar. That is the hierarchy.
